Only Beauvoisin (either directly or through licenses or authorisations) is authorised to use the elements making up the Website, including domain names, trademarks, designs, models, images, and editorial content displayed on it.

Any use of all or part of the Website, including downloading, reproducing, transmitting, displaying, or distributing it for purposes other than personal and private consultation by the user for non-commercial purposes, is strictly prohibited. Any breach of these provisions may expose the offender to sanctions under the French Intellectual Property Code, particularly regarding copyright and trademark infringement, as well as civil liability provisions.

Beauvoisin endeavours, as far as possible, to ensure permanent access to the Website but is under no obligation to do so. Beauvoisin may therefore interrupt access to the Website, particularly for maintenance, updates, or any other reason, including technical or editorial reasons, without prior notice and without incurring any liability for the consequences of such interruptions for users or third parties.

Furthermore, Beauvoisin cannot be held liable if users are unable to access all or part of the Website due to technical issues, including but not limited to:

  • Internet network failure and/or congestion;
  • Failure of Internet service providers;
  • Human or electrical error;
  • Malicious intervention;

GENERAL TERMS AND CONDITIONS OF SALE

1. INTRODUCTION

1.1 The Website enables customers to book rooms and additional services at Beauvoisin Hotel (hereinafter referred to as the “Hotel”).

1.2 These General Terms and Conditions of Sale (the “General Terms and Conditions of Sale”) apply to the booking of rooms and additional services at the Hotel (the “Services”) and are those in force on the date your booking is confirmed on the Website. They cancel and replace any previous terms and conditions previously published online and/or accepted by the Customer.

1.3 Any booking made on the Website requires prior consultation and unconditional acceptance of these General Terms and Conditions of Sale. Customers are advised to download and/or print these General Terms and Conditions of Sale and retain a copy as they may be amended from time to time. However, any amendment made after a booking has been confirmed shall not apply to that booking.

1.4 The Customer accepts these General Terms and Conditions of Sale, together with the specific conditions, including financial conditions, applicable to each booking by completing the booking process and ticking the box stating: “By choosing to book, I acknowledge that I have read and accepted Beauvoisin’s General Terms and Conditions of Sale and Privacy Policy” or any similar statement displayed on the Website.

1.5 The Customer acknowledges having access to all necessary information on the Website, including in particular: the full contact details of the Hotel available under the “Terms of Use” section, the main and essential characteristics of the accommodation and additional services offered, these General Terms and Conditions, any specific conditions applicable to a particular offer, accommodation or additional service, the Privacy Policy, the rates applicable to accommodation and additional services, the maximum number of accommodations that may be booked by a Customer, the accepted payment methods, and the duration of the contract concluded between the Customer and the Hotel.

1.6 The term “Customer(s)” refers to any natural person placing an order on the Website as a consumer, for private or professional purposes, provided such purposes are unrelated to the hospitality industry.

1.7 As a consumer, the Customer benefits from rights that may not apply if the Services are booked in the course of a professional, commercial, industrial, craft or liberal activity.

1.8 Only Customers who (i) have reached the legal age of majority (eighteen years old in most countries) and (ii) have the legal capacity to enter into contracts are authorised to book Services on the Website.

1.9 The information provided on the Website is available in both French and English.

2. PURPOSE

2.1 These General Terms and Conditions of Sale define the terms and conditions applicable to online bookings of Services made through the Website.

2.2 These General Terms and Conditions of Sale do not govern the offer, booking or purchase of services provided by entities other than Beauvoisin or through third-party websites and/or mobile applications. Customers are advised to review the terms and conditions applicable to such third-party services before confirming any booking, as Beauvoisin shall under no circumstances be held liable for services provided by third parties.

2.3 These General Terms and Conditions of Sale apply to all stages of the booking process and to the follow-up of the Customer’s booking.

3. BOOKINGS

3.1 The Website offers an online booking process for hotel rooms, limited to a maximum of four (4) rooms per booking, as well as additional services.

3.2 Accommodation offers presented on the Website are accompanied by an information sheet including, where applicable: the type of commercial offer available (for example: “Book Now and Save”, “Last Minute Promotion -10%”, “Flexible Rate”, “Room and Breakfast”, “Your Birthday at the Hotel”), a description of the room(s) concerned, any ancillary services included in the offer, the cancellation and amendment conditions applicable to the booking, any specific sales conditions, payment terms and conditions, and these General Terms and Conditions of Sale.

3.3 The Website may occasionally feature special commercial offers available exclusively through the Website and not through any third-party websites, including temporary offers such as “Best Rate Guaranteed”. Customers are invited to consult the specific conditions applicable to such offers, which are communicated at the time of booking. These offers may be modified at any time by Beauvoisin, which shall only be contractually bound by bookings duly confirmed by the Customer. Beauvoisin shall not be held liable for the modification or withdrawal of any commercial offer from the Website.

3.4 The Customer selects the Services offered on the Website. The Customer is solely responsible for choosing the Services and ensuring that they meet their needs. Consequently, Beauvoisin cannot be held liable in this respect.

3.5 Customers may book a maximum of four (4) rooms through the Website. For bookings exceeding this number or for any request for services not displayed on the Website, Customers are invited to contact Beauvoisin directly. Group booking conditions may apply for bookings of five (5) rooms or more, including the payment of a deposit and specific cancellation and amendment conditions. For further information, Customers should contact Beauvoisin directly.

3.6 A booking shall be deemed accepted by the Customer upon completion of the booking process.

3.7 The Customer certifies that all information provided when booking Services is accurate and truthful. Beauvoisin reserves the right to refuse or cancel any booking made by a person who uses the Website fraudulently or who fails to comply with these General Terms and Conditions of Sale.

4. BOOKING PROCESS

4.1 Bookings are made by the Customer using the online booking form available on the Website.

4.2 When making a booking, the Customer must provide certain mandatory information, including personal data required for the processing of the booking by Beauvoisin. Beauvoisin reserves the right to refuse any booking if such information is missing or inaccurate. The Customer must also indicate the number of persons benefiting from the Services, as well as their ages, with any minor over the age of 13 being considered an adult.

4.3 The booking process on the Website includes, in particular, the following steps:

  • Step 1: Selection of the arrival date on the Website homepage (www.beauvoisin.co);
  • Step 2: Access to a secure page displaying the available offers for the selected Hotel and dates, and allowing the Customer to specify or amend any of the choices made (arrival and departure dates, number of room(s), number of guests, etc.);
  • Step 3: Consultation and selection of an offer;
  • Step 4: Selection, where applicable, of one or more additional Services;
  • Step 5: Verification of the booking details, total price and applicable conditions, with the possibility to amend the selected options;
  • Step 6: Provision of the Customer’s contact details;
  • Step 7: Entry of payment card details where a guarantee or prepayment is required;
  • Step 8: Review and acceptance of the General Terms and Conditions of Sale, the Privacy Policy and, where applicable, any specific terms and conditions prior to confirming the booking;
  • Step 9: Confirmation of the booking by the Customer.

5. BOOKING CONFIRMATION

5.1 The Website acknowledges receipt of the Customer’s booking by sending an email containing: (i) the booking reference number, (ii) a summary of the booking, including the Services booked, the price of the Services and the conditions applicable to the selected rate accepted by the Customer, and (iii) these General Terms and Conditions of Sale, together with, where applicable, information relating to after-sales service and the contact details to which complaints may be addressed.

5.2 The booking shall be deemed final and binding upon receipt by the Customer of the booking confirmation email sent by Beauvoisin.

5.3 The duration of the agreement concluded between the Customer and the Hotel corresponds to the duration of the accommodation service booked.

6. CANCELLATION OR MODIFICATION OF A BOOKING BY THE CUSTOMER

6.1 Pursuant to Article L.221-28 of the French Consumer Code, the Services offered on the Website do not give rise to the right of withdrawal provided for under Articles L.221-18 et seq. of the French Consumer Code relating to distance selling contracts.

6.2 The conditions applicable to the selected rate specify the terms governing the cancellation and/or modification of the booking.

6.3 Prepaid bookings cannot be modified or cancelled. Any amounts paid in advance constitute a deposit and are non-refundable. This shall be specified in the terms and conditions applicable to the selected rate and accepted by the Customer.

6.4 Where cancellation of a booking is permitted, the Customer must contact the Hotel’s customer service department directly. Contact details are available on the Hotel’s Website.

6.5 Certain promotional offers available on the Website may be subject to specific cancellation and modification conditions, which are detailed in the specific terms and conditions included in the description of the relevant offer.

6.6 Unless otherwise specified in particular conditions, bookings may be cancelled or modified free of charge up to forty-eight (48) hours prior to the scheduled arrival time. For cancellations made less than 48 hours before arrival, a one-night penalty will automatically be charged to the Customer’s credit card provided at the time of booking.

6.7 In order to modify a booking made through the Website, the original booking must first be cancelled in accordance with the above conditions and a new booking must then be made.

7. NO-SHOWS AND EARLY DEPARTURE

7.1 Any booking made through the Website provides for check-in from 3:00 p.m. and check-out by 12:00 noon. The Customer must arrive at the Hotel before 6:00 p.m. or notify the Hotel in the event of late arrival. If the Customer fails to arrive before 6:00 p.m. without prior notice, a one-night penalty will automatically be charged to the payment card provided at the time of booking, except in the case of prepaid bookings.

7.2 In the event that the Customer vacates the reserved room after the required check-out time (12:00 noon), an additional night’s stay shall be charged as a penalty.

7.3 Any interruption of the stay prior to the scheduled departure date shall result in payment of the full agreed price.

8. PRICES OF THE SERVICES

8.1 The price of the Services is indicated on the Website before booking, in the description of the relevant offer, and during the booking process.

8.2 Rates are quoted per room, for the number of guests indicated, according to the selected period, and include only those Services expressly mentioned in the booking.

8.3 The price of each Service is expressed inclusive of all taxes (VAT included), excluding city tax, and specifies the amount of VAT applicable to the Service.

8.4 The euro is the commercial currency for bookings; therefore, payment must be made exclusively in euros. Prices displayed on the Website in other currencies are indicative only and may not accurately reflect the amount payable, which shall be stated in euros at the time the booking is confirmed by the Customer.

8.5 Prices displayed on the Website may be modified by Beauvoisin at any time without prior notice. Only the price indicated in the booking confirmation shall be contractually binding.

9. PAYMENT

9.1 Unless otherwise specified in particular conditions, payment for the Services shall be made at the Hotel at the end of the stay. In the case of prepayment, amounts paid constitute a deposit and are non-refundable.

9.2 In the event of a no-show or late cancellation giving rise to a one-night penalty, the payment card details provided by the Customer at the time of booking shall be used to process the corresponding charge.

10. STAY AT THE HOTEL

10.1 In accordance with applicable French regulations, the Customer may be required to complete a police registration form upon arrival at the Hotel. In order to determine whether the Customer is subject to this requirement, an identity document may be requested.

10.2 Beauvoisin Hotel welcomes certain pets, provided that they are kept on a leash or in a cage when in the common areas of the establishment. For further information regarding these conditions, Customers are advised to contact the Hotel directly. Throughout the stay, pets remain under the sole responsibility of the Customer.

10.3 During their stay, the Customer undertakes to use the room rented to them in a reasonable manner and with due care. The Hotel may require the Customer to leave the Hotel, without any compensation being paid, and to settle the full amount of the booked Services, particularly in the event of behaviour contrary to public decency or public order, any damage, deterioration or act of vandalism caused by the Customer, their employees or any persons under their responsibility during their occupation of the premises, affecting any movable or immovable property, furniture, decorative elements or any other property within the Hotel. In addition, the Customer shall be required to fully reimburse any damage caused by their actions. Beauvoisin reserves the right to take any appropriate action to obtain compensation for any loss suffered.

10.4 Beauvoisin provides Customers with free Wi-Fi internet access throughout the Hotel. The Customer undertakes not to use the IT resources made available to them for fraudulent or unlawful purposes, including, but not limited to, infringing third-party rights and/or illegally downloading works protected by copyright or related rights, as prohibited under Article L.335-2 of the French Intellectual Property Code.

10.5 Non-smoking Hotel. Beauvoisin Hotel is an entirely non-smoking establishment. Smoking is strictly prohibited throughout the Hotel, including in guest rooms, common areas and on balconies. Failure to comply with this prohibition may result in cleaning and/or restoration charges being billed to the Customer.

11. RELOCATION – FORCE MAJEURE

11.1 In the event that the reserved room becomes unavailable at the Hotel, Beauvoisin reserves the right to accommodate the Customer, in whole or in part, in a hotel of an equivalent or higher category offering similar services. The transfer shall be entirely at Beauvoisin’s expense and no additional costs shall be charged to the Customer.

11.2 Beauvoisin shall not be held liable for any failure to fulfil its obligations where such failure results from an event of force majeure, for the duration of such event, and undertakes to make all reasonable efforts to limit its effects.

11.3 For the purposes of this Article, force majeure shall mean any event or circumstance that the parties could not reasonably foresee or control at the time of booking due to its external, unforeseeable and irresistible nature. In addition to events recognised as force majeure by French courts and tribunals, force majeure shall include, but not be limited to, total or partial strikes, whether internal or external to the Hotel, terrorism, wars or uprisings, severe weather conditions, epidemics, disruptions to transport or supply systems for any reason whatsoever, earthquakes, fires, storms, floods, water damage, and IT system failures preventing a party from carrying on its normal business activities.

12. PERSONAL DATA

12.1 In accordance with French Law No. 2018-493 of 20 June 2018 relating to the protection of personal data and Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR), Customers are informed that the information provided at the time of booking is subject to processing for the purposes of managing bookings and customers, invoicing and payment requirements, and commercial prospecting activities.

12.2 Customers are also informed that, for the security of persons and property, the Hotel operates a video surveillance system within the common areas of the building.

12.3 Customers have the right to access, rectify, transfer and erase their personal data by contacting Beauvoisin at the following email address: hello@maisonmere.co.

12.4 Customers may obtain information regarding the manner in which Beauvoisin processes their personal data by consulting the Privacy Policy or by submitting a request to the following email address: hello@maisonmere.co, or by writing to our registered office at: 7 rue Mayran, 75009 Paris, France.

12.5 Customers may make use of the Bloctel service, a free service allowing them to register their own telephone number, as well as those of their spouse or children, in order to object to telephone marketing calls. Decree No. 2022-1313 of 13 October 2022 provides that, as of 1 March 2023, telephone marketing to consumers is authorised only from Monday to Friday, between 10:00 a.m. and 1:00 p.m. and between 2:00 p.m. and 8:00 p.m. It is prohibited on Saturdays, Sundays and public holidays. These restrictions apply both to individuals not registered on the Bloctel opposition list and to those registered but contacted in connection with an existing contract. 13. MEDIATION – JURISDICTION

13.1 In the event of a dispute, after first contacting the establishment at hello@maisonmere.co and failing to obtain a satisfactory response within a period of up to one (1) year, the Customer may refer the matter to the European Mediators Association (Association des Médiateurs Européens), whose contact details are as follows:

14. GENERAL PROVISIONS

14.1 These General Terms and Conditions of Sale are updated regularly, particularly to reflect changes in legislation and regulations. The new General Terms and Conditions of Sale shall apply as from the date they are published on the Website.

14.2 These General Terms and Conditions of Sale, together with the Privacy Policy, the Terms of Use of the Website and, where applicable, any specific terms applicable to particular offers, constitute the entire agreement concluded between the Customer and Beauvoisin in relation to bookings made through the Website and supersede all previous terms and conditions.

14.3 Should any provision of these General Terms and Conditions of Sale be declared wholly or partially invalid for any reason whatsoever, the remaining provisions shall remain in full force and effect.
